AGREEMENT
The site http://www.plong.com (hereinafter referred to as the "Site") is a big music archives which functions as an online mp3 music store. Make use of the resources of the Site may any registered user. The present agreement ("Agreement") is a contract concluded between you and Plong.com administration (the "Administration"), which stipulates your rights and duties on the Site, and sets the framework for the use of services provided by Plong.com.
The registration of a user is possible only if the user has examined and has agreed with all the terms of the user Agreement. If you disagree with any clause of this document, you should stop registration and using of the Site.
By continuing registration on this Site you confirm that:
1. You have read and understood the present Agreement in full
2. You agree with all the clauses of the present

1. GENERAL PROVISIONS
1.1. The availability over the Internet of the Plong.com materials is authorized by the license № LS-3M-06-109 of the Russian Multimedia and Internet Society (ROMS).
1.2. In accordance to the license terms the Administration of the site pays license fees for all materials downloaded from the Site
1.3. All the materials of the Site are the objects of intellectual property, they are protected by the Law of the Russian Federation "On Copyright and Related Rights" and are solely for personal use. Any further distribution, resale or broadcasting are prohibited. The Administration of Plong.com alerts that according to the present legislation of Russian Federation any infringement of author’s rights, such as illegal distribution, reproduction, performancing of copyright objects, a civil, administrative and criminal responsibility are provided.
1.4. The Administration of Plong.com does not attempt to control the actions of its Users, and so alerts that User bears sole responsibility for any use and distribution of all materials received from Plong.com.
1.5. Only a registered and authorized user has a right to download mp3 files and to listen to preview samples. Downloading of mp3 files requires payment, though preview listening is free of charge. Unregistered user may only examine the catalog of the Site and the map of the Site.
1.6. Сorrespondence, technical and informational support is accesible only for registered authorized Users through the Site “Feedback” form.
1.7. The Administration of Plong.com reserves the right to change, correct and supplement this Agreement. Administration shall undertake to notify you of all changes to the present Agreement. In the event that you disagree with any clause of the changed Agreement, you should terminate your registration on the Site immediately and abstain from using it.
2. REGISTRATION OF A USER
2.1. Registration of a User consist in providing certain personal data such as full name, country of residence, e-mail address, login and password to the Site Administration.
2.2. The necessity of Registration of User consist in following:
2.2.1. During the registration each User receives a unique personal account number for working at the Site and to be able to add to the balance.
2.2.2. Preservation of all the information about the files which were downloaded and about all payments.
2.2.3. Every User may receive bonuses depending on the sums of money added to the balance (the amount of bonuses are specified in the tariff’s section) and also for help such as giving an additional information describing the content of the Site.
2.2.4. The Site Administration send to the User’s e-mail a registration activation code, information about the User’s balance and about the necessity of its replenishment, informs about blocking of the account and its following zeroing, notifies of all changes to the present Agreement. If during the registration the User subscribes for the delivery of news it also comes to the e-mail.
2.3. For a successful registration User should provide the Site Administration with certain personal data:
1. Full name;
2. e-mail address;
3. login;
4. password;
5. country of residence.
2.3.1. After the User has given his/her personal data, the Site Administration sends him/her a link with a registration activation code to the e-mail. The real e-mail address is essential for completing the registration, as giving of an incorrect e-mail entails impossibility of completing the registration. After successful registration activation User receives a letter containing login and password for authorization on the Site. For safety it is strongly recommended not to keep the letter containing login and password for the authorization on the post server or in the e-mail client.
2.3.2. Authorization allows identify a registered User and gives full access to Plong.com services.
2.3.3. For safety on default the authorization on the Site is valid during unlimited period of time until User close the internet-browser and delete cookies. If before authorizing User has marked option of “memorization” it would let safe cookies even after closing the internet-browser and authorize on the Site automatically.
2.4. The Account which appears on the Site after the registration of a User contains information about User, his/her orders, about state of the account. It allows to use all the services of the Site for which registration is necessary. During the time the registration is active User may change his/her personal data. However User can’t delete the Account by him/herself. If it is necessary to terminate registration, User should apply to the Support Service of the Site. If the user terminates registration, it is impossible to withdraw any balance remaining on the personal account. No other payments will be returned and no losses will be reimbursed.
2.5. The owner of personal Account bears all responsibility for the login and password of the Account. User bears all responsibility for unapproved access to the Account.
2.6. User undertake not to pass his/her login and password to other people under no pretext. The Site Administration has a right to delete the Account of the User if notices simultaneous access to any services of the Site from more than 2 (two) IP addresses. In this case the balance remaining on the personal account doesn’t return.
3. PAYMENTS
3.1. Payment fulfils in US dollars or in rubles according to the rate of exchange of The Central Bank of the Russian Federation at the moment of paying.
3.2. The price of the files and the periodicity of replenishing the balance is determined by the Tariff chosen by User. The description of Tariffs is on the page http://www.plong.com/page_pid_92_lang_1.aspx, which is accessible only for authorized registered Users. Tariffs differ by quantity of Mb given to User, by price of 1 Mb, by period of its validity and by amount of bonuses. Replenishing the balance accures after response of the system that the money were successfully ordered.

3.3. Every Tariff has a fixed period of its validity. User may use paid services of the Site only during the paid period.
Payment & period of account validity:
over 40$, +4 months
from 20 to 39,99$, + 3 months
from 10 to 19,99$, + 2 months
from 5 to 9,99$, + 1 month
3.4. After the termination of Tariff validity period the positive balance and the bonuses which were not spent block on the User Account. Account blocking doesn’t allow to use paid services of the Site, but keeps the positive balance.
3.5. The Account doesn’t block if Tariff validity period was prolongated. The period of Tariff validity increases according to the period of validity of a new paid Tariff. User may increase the Tariff validity period by paying for several periods of the Tariff.
3.6. Bonuses of Tariffs for any quantity of periods enter in a User Account couple with the primary payment.
3.7. If User chose a new Tariff for replenishing a balance, new Tariff comes into operation at the date which follows after the termination of present Tariff validity.
3.8. If the balance becomes 2 dollars (hereinafter “Low Balance”) the Site Administration sends to User an e-mail notification about necessity of Balance replenishing.
3.9. 7 days prior to the termination of validity period of the Account according to the chosen Tariff, the Site Administration sends to User an e-mail notification about forthcoming Account bloking.
3.10. If User doesn’t replenish the balance for 7 (seven) days from the moment the notification about Acount bloking was sent, the Account blocks. The Site Administration sends to User’s e-mail a notification about completed Account blocking and forthcoming Acount zeroing.
3.11. If User doesn’t replenish the balance during 14 (forteen) days after the Account blocking the Balance zeroing. The Site Administration sends to User’s e-mail a notification about completed Acount zeroing.
3.12. Users are offered the following methods of payment for the service:
? by way of buying cards of express payment “Music Card” (only for citizens of Russian Federation). For the replenishment of the account User should chose «Activate Card» and input PIN-code of the card. Money reseipt immediately;
? by a bank transfer through any bank which fulfils such operation (only for citizens of Russian Federation). The Account will be replenished as soon as the Site Administration receives the receipt with the information from the bank that the payment has been entered. The sum entered in the Account converts to US dollars according to the rate of exchange of The Central Bank of the Russian Federation at the date of payment receiving. In order to hasten the entering of the money into Account User may scan front part of the receipt, so that the notes of the bank and all essential elements could be read easily, and send file with the image of the receipt to bill@plong.com.
4. DOWNLOADING (BUYING) OF FILES
4.1. Process of downloading of files (hereinafter Tracks/Releases) begins after attempt of User to download (hereinafter buy) Track/Release.
4.2. Buying of a music file is possible only if three conditions are observed:
1. User confirmed his/her intention to buy a track or release chosen;
2. User’s balance is sufficient for buying Tracks or Releases which were chosen;
3. User’s personal Account has status «Active».
4.3. Before buying User may listen to preview samples of Tracks and Releases in browser.
4.4. User can download Tracks and Releases both through browser by clicking on Track’s name or on the icon “Download” and with the help of specialized programms, such as ReGet, FlashGet, GetRight.
4.5. When buying Track or Release the filename extension changes according to User’s personal settings.
4.6. The name of a Track which was bought arranges according to personal settings. On default the ame of the track arranges in the following way:
1. Track number;
2. Artist name ;
3. Track name.
The names of russian Tracks automatically transliterate. Total leingh of saving mp3 file path is limited by 260 (two hundred eighty) symbols.
4.7. There are no download speed limitations and no restrictions on the quantity of files downloaded per day.
4.8. The price of downloading (of mp3 file) calculates from a file size (amount of Mb) multiplied by the price of 1 Mb in accordance with the Tariff chosen by User, but can’t be less than 0,1$ for every downloaded file.
4.9. Charging off the money from User Account accures at the moment the files added to the Basket.
4.10. User has right to download paid music file during the «period of link activness in the basket». «Period of link activness in the basket» lasts 14 (fourteen) days from the moment the music file was paid.
4.11. If User doesn’t try to download file more than 14 days («period of link activness in the basket»), the link on the file deletes. The cost of the file returns to User Balance.
4.12. If User downloades (or tries to download) music file at the «period of link activness in the basket», he/she has right to renew downloading for 12 (twelve) hours from the first attempt to download the file. If User doesn’t manage to download the music file during this period of time he/she should buy it anew.
4.10. After the file downloading process is terminated, the list of the files which were downloaded keeps in User pesonal cabinet, on the page «Archive downloaded».
4.11. The Site Administration doesn't answer for the content and reliability of the materials, given to the User.
4.12. The User agrees not to appeal to the Plong.com concerning the quality of the given facilities and also concerning any possible damage, received by the User after the using and getting the access to the Services of Plong.com.
4.13. The Administration of the Site is not responsible for the temporary bugs and interruptions in the work of the Services.
4.14. The Site Administration is not responsible for the quality of the channels of communication, used by the User, so Plong.com is not responsible for the financial and any other damage, brought by the use of the channels of communication of the low quality.
4.15. The User is responsible for the use of any hardware support.
5. PRIVACY POLICY
5.1. The Site Administration guarantees to User not to abuse any data received during registration (and other information concerning User Balance, payments, files downloaded etc.) and not to disclose it. This data keeps as confidential information. In case of breaching this regulation the Administration of the Site obliges to compensate all damage caused by these actions.
5.2. The Site uses cookies, which is a common practice on the Internet. Cookies are only used for storing technical identification information after the user's authorization on the Site. Cookies are not used to store any other data (logins, passwords, financial and other information). Disabling cookies may lead to the inability to access those parts of the Site which require authorization.
6. OTHER CONDITIONS
6.1. The User uses http://www.plong.com at his own risk.
6.2. All hardware support, that is used and given on the Site is the property of it's producer (the proprietor of the rights) and is protected by local and international laws of the intellectual property rights and copyrights.
6.3. The Proprietor doesn't give the User any insurance that the User will get facility using the Services.
